US Chapter Luncheon "How to Avoid Partner Disputes: Lessons of Dispute Resolution"

Join the US Chapter for a luncheon presentation on "How to Avoid Partner Disputes: Lessons of Dispute Resolution." Unless you work for a firm that has unlimited capital and little risk aversion, you typically seek to bring partners into projects who can share technical and financial risks and maybe provide needed expertise. Sometimes getting different perspectives from new participants can result in a better project. But in any relationship, each participant may have different ideas of what is best for the project or what they expected the outcome to be. There is also the possibility that a partner may have a change in circumstances (financial difficulties, changes in management and ownership, etc.) that may affect their commitment to the project. Also, there is always the possibility that the objectives of the partner turn out to be not in the best interests to other partners and the project. All these circumstances can lead to disagreements.

AIPN usually spends a lot of time outlining the various venues, laws, and logistics of dispute resolution (where and how) when some effort could be directed at preventing disputes in the first place. This luncheon will discuss the following topics:

- What articles in our joint operating agreement seem to be the source of the most disputes?
- Do differences in partner size matter?
- Are there any mechanisms available to reign in the cost of dispute resolution (limit discovery, use of expert witnesses, etc.)?
