The Declaration on the Rights of Indigenous Peoples (UNDRIP) was adopted by the General Assembly of the United Nations in 2007. However, with the more recent adoption of domestic implementation legislation for the Declaration by both the province of British Columbia (2019) and the federal parliament of Canada this last summer (2021), there is increased interest in the Declaration, and, more generally, increased attention to the rights of Indigenous peoples under international law. 

Organized by the Canada chapter, this webinar aims to place the Declaration within the broader context of international human rights law by considering the relevance of both general international human rights instruments such as the International Covenant on Civil and Political Rights (ICCPR) (1966) and the Convention on the Elimination of All Forms of Racial Discrimination (1966) and regional human rights instruments, as well as more specific instruments such as the Declaration itself and the Indigenous and Tribal Peoples Convention (Convention 169 of the International Labour Organization, 1989).  

While the webinar will principally offer general context, it will also aim to address issues of specific interest to the resource sector such as the principle of free, prior and informed consent (FPIC). By drawing on speakers from both Norway and Chile as well as Canada, the webinar will also offer different regional perspectives on the relevance of the above instruments. For example, Professor Ravna will provide commentary on the very recent decision of Norway’s Supreme Court striking down wind farm licences on the basis of interference with Sámi reindeer herding rights protected by the ICCPR.
